Terms of Service

These Terms of Service govern your access to vortexfps.com, use of our free educational content, purchase and use of our proprietary software, and purchase or receipt of digital optimization services. Please read them carefully before using the site, downloading software, or making a purchase.

Effective October 28, 2026 Maryland · United States Software + Digital Services
Section 01 · Agreement

Acceptance and Scope

These Terms of Service (the “Terms”) are a binding agreement between you and Vortex FPS (“VortexFPS,” “Company,” “we,” “us,” or “our”) governing your access to and use of vortexfps.com and any related pages, content, downloads, software, utilities, scripts, digital files, optimization configurations, guides, support, and services we provide (collectively, the “Services”).

By accessing or using the website, downloading or using any VortexFPS software, submitting system information, purchasing a digital product or service, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access, download, purchase, or use the Services.

Additional written terms presented for a particular product, service, promotion, or order form are incorporated into these Terms. If there is a direct conflict, the more specific written terms for that product or service control only as to that conflict.

Section 02 · Eligibility

Eligibility and Age Requirements

The Services are intended for a general audience and are not directed to children under 13. You must be at least 13 years old to use the website or access free content. If you are between 13 and 17, you may use free portions of the Services only with the involvement and permission of a parent or legal guardian where required by applicable law.

You must be at least 18 years old, the age of legal majority in your jurisdiction, or otherwise legally capable of entering a binding contract to make a purchase, submit payment, order a custom service, or acquire a paid software license. A parent or legal guardian must make the transaction for a minor where legally permitted.

By making a purchase, you represent and warrant that you have legal capacity to enter into this agreement and that all information you provide is accurate and complete.

Section 03 · Educational Material

Free Information and Educational Disclaimer

Articles, guides, benchmarks, examples, instructions, recommendations, performance data, hardware information, registry settings, BIOS settings, operating-system changes, driver settings, and other free content are provided strictly for educational and informational purposes.

No free content constitutes a guarantee, warranty, professional engineering service, or promise that a particular setting is appropriate for every system. Hardware, firmware, operating-system builds, drivers, cooling, silicon quality, game engines, peripherals, and workloads vary materially between systems.

Benchmarks and performance examples reflect particular systems and test conditions. Homepage game benchmarks show the combined application of Vortex FPS services, not the software in isolation. The MouseTester polling-rate before-and-after graphs show software-only results; they do not measure end-to-end input latency. We do not guarantee any specific increase in average FPS, 1% lows, polling stability, responsiveness, latency reduction, thermals, power consumption, stability, or other performance outcome.

Section 04 · EULA

End User License for VortexFPS Software

Subject to your compliance with these Terms and payment of any applicable fees, VortexFPS grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the purchased VortexFPS software for your own personal, non-commercial use on computer systems that you own or control, unless the applicable product page expressly states a different scope.

Endgame Affinity device limit: Each key permits activation on one PC at a time for the purchaser’s personal use. It may not be shared with another person. Contact support with your order details to request a reset for a replacement PC or a hardware change; a reset must not be used to operate the same key on multiple PCs.

Activation and connectivity: Initial activation and periodic validation require internet access to our Cloudflare-hosted licensing service. The current version attempts validation on launch after seven days since its last successful validation. If the service cannot be reached, an existing valid activation may continue for less than 30 days from the last successful validation, after which online validation is required. This grace period does not override a confirmed license rejection. Licensing-service outages may delay new activations and key issuance.

The software is licensed, not sold. Your purchase does not transfer ownership of the software, source code, algorithms, interfaces, trade secrets, documentation, branding, or other intellectual property. A “lifetime” license has no scheduled subscription renewal or recurring license fee for the purchased product or version. It does not guarantee perpetual updates or compatibility with future operating systems, third-party platforms, game updates, or hardware. Use remains subject to the license conditions and activation requirements described above; this wording does not remove any mandatory remedy for a failure to supply the purchased product.

The license may be revoked or suspended if you materially breach these Terms, obtain the software through fraud or an unauthorized payment reversal, redistribute it, compromise license controls, or use it unlawfully.

Section 05 · License Restrictions

Prohibited Uses of Software

Except to the limited extent that applicable law expressly grants a non-waivable right, you may not, directly or indirectly:

  • copy, publish, upload, mirror, share, distribute, sublicense, rent, lease, lend, sell, resell, or commercially exploit the software or any portion of it;
  • reverse engineer, decompile, disassemble, decode, translate, derive source code from, or attempt to discover the software’s source code, algorithms, logic, or non-public implementation details;
  • modify, patch, crack, bypass, disable, circumvent, remove, or interfere with license checks, access controls, copyright notices, security mechanisms, or technical restrictions;
  • create or distribute derivative works, altered binaries, repackaged installers, competing products based substantially on the software, or tools designed to replicate protected non-public functionality;
  • use the software to provide a paid service, managed service, resale service, or commercial optimization service to third parties without our express written permission; or
  • use the software in violation of law, third-party rights, game rules, platform terms, or anti-cheat policies.
Section 06 · Third-Party Games

Game Platforms, Anti-Cheat Systems, and Account Risk

VortexFPS is not affiliated with, sponsored by, endorsed by, or approved by any game publisher, game platform, anti-cheat provider, operating-system vendor, hardware manufacturer, or third-party application unless expressly stated in writing.

Third-party platforms may change their rules, detection methods, security software, APIs, drivers, or technical requirements without notice. We do not represent or warrant that VortexFPS software or recommended system changes will be accepted by every game, anti-cheat system, platform, tournament, application, or publisher.

Section 07 · Digital Services

Optimization Services and Delivery

VortexFPS may provide custom digital optimization services, including system-specific recommendations, configuration files, BIOS or operating-system tuning guidance, remote or one-on-one optimization sessions, performance analysis, troubleshooting, and execution of agreed software or system settings (collectively, “Optimization Services”).

The scope of a particular Optimization Service is defined by the applicable product page, order description, written message, or other written agreement between you and VortexFPS. Unless expressly agreed otherwise, the service does not include hardware repair, data recovery, guaranteed overclock stability, ongoing system administration, cybersecurity monitoring, game-account support, or indefinite post-delivery support.

Software delivery: Following successful payment, Stripe’s post-payment redirect opens the Dropbox download page. The activation key is sent separately by email or Discord, usually within a few minutes after payment verification. This is an estimate, not a guaranteed deadline; availability, payment verification, and technical outages can cause delays. If a redirect is interrupted or a key is missing, contact vortexoc@vortexfps.com or vortex_oc on Discord with your order details. Opening a confirmation URL alone does not verify payment.

Custom services: Any stated delivery target starts after payment verification and receipt of the complete, usable system details and files needed for the order. Scheduling and the agreed scope may affect completion time. We will communicate material delays or compatibility problems through the contact details you supply.

A digital deliverable is supplied when the purchased download, configuration, guide, report, or other file is made available or sent through the agreed delivery channel. For software requiring a key, supply includes both access to the software and a working activation key; a download redirect without a required key does not alone complete delivery. A remote or one-on-one service is complete when the agreed work has been performed. These descriptions do not limit any mandatory consumer right.

Section 08 · Your Responsibilities

Backups, Access, and System Responsibility

Before applying any recommendation or allowing any Optimization Service to begin, you are responsible for creating and verifying adequate backups of all personal data, critical files, passwords, encryption recovery keys, system state, BIOS profiles where available, and any other information needed to restore your computer.

You are responsible for maintaining access to any operating-system installation media, recovery environment, motherboard recovery procedure, account credentials, software licenses, and backups reasonably necessary to recover from an unexpected failure.

If you request remote assistance, you authorize VortexFPS to access and make the changes reasonably necessary to perform the agreed scope. You remain responsible for reviewing requested changes and for providing accurate hardware, software, BIOS, cooling, power-supply, stability, and other system information.

VortexFPS may decline, pause, or stop work where hardware is unsupported, submitted information is incomplete or inaccurate, a requested change appears unsafe, required access is unavailable, or continuing would create an unreasonable risk.

Section 09 · Commerce

Payments, Digital Goods, Refunds, and International Purchases

Prices are shown in U.S. dollars unless otherwise stated. You authorize the applicable payment processor to charge the payment method you provide for the displayed price, taxes if applicable, and any other charges you affirmatively approve. If your payment method is denominated in another currency, your bank, card issuer, or payment processor may apply currency conversion rates or foreign-transaction fees that are outside VortexFPS’s control.

Where required by law, applicable sales tax, value-added tax (VAT), goods and services tax (GST), or similar transaction taxes may be calculated, collected, or remitted in connection with your purchase. You remain responsible for taxes or government charges lawfully imposed on your transaction to the extent they are not collected at checkout and applicable law permits that responsibility to be placed on you. Nothing in these Terms shifts any tax obligation that the law requires VortexFPS to bear directly.

Refund policy: Except where required by applicable law or expressly agreed otherwise in writing, software and digital files already supplied and Optimization Services already performed are final and non-refundable. We do not offer discretionary change-of-mind refunds for those supplied products or performed services. For software requiring activation, supply includes a working key as described in Section 7. Before supply or completion, contact us promptly about cancellation; any entitlement relating to undelivered products or unperformed work depends on applicable law and the agreed scope.

Support: If you have an activation, compatibility, delivery, or service problem, contact vortexoc@vortexfps.com or vortex_oc on Discord with your order details and a description of the issue. Our normal response is troubleshooting, support, or correction of the supplied work, rather than a discretionary refund. Support is not an exclusive remedy where the law requires a refund, repair, replacement, repeat performance, or another remedy, and it does not extend a statutory deadline.

Some jurisdictions provide statutory cancellation or withdrawal rights for online purchases. Those rights remain available where they cannot lawfully be waived. Where applicable law permits immediate supply of digital content or commencement of a digital service after a consumer gives prior express consent and acknowledges the resulting loss or expiration of a withdrawal right, delivery may begin on that basis. Any refund or cancellation entitlement will be determined under the mandatory law that applies to the transaction.

If we cannot supply a paid product or perform the agreed service, and you do not accept an alternative or revised scope, we will refund the amount paid for the undelivered product or unperformed portion of the service, as applicable. Nothing in this section limits a refund, cancellation, conformity right, chargeback right, or consumer remedy that cannot lawfully be waived.

Payments may be processed by third-party processors such as Stripe. VortexFPS does not receive or store your full payment-card number or CVV. Your payment is also subject to the processor’s terms and privacy practices.

Section 10 · Payment Disputes

Chargebacks and Payment Fraud

You may use legitimate dispute rights provided by law and your payment provider. However, you may not knowingly make a false claim, misrepresent whether a product or service was delivered, falsely deny authorizing a transaction, or initiate a chargeback in bad faith after receiving or accessing the purchased product or service.

A fraudulent or bad-faith payment reversal may result in immediate suspension of support, revocation of the affected software license, termination of access to paid materials, refusal of future service, and recovery of unpaid amounts, processor fees, collection expenses, and reasonable legal costs where permitted by law.

Before initiating a payment dispute, we encourage you to contact us so we can attempt to resolve delivery, compatibility, or billing issues directly. This sentence does not waive or delay any non-waivable right or deadline imposed by your card issuer or applicable law.

Section 11 · Outside Services

Third-Party Tools, Links, and Services

The website and our guides may link to or reference third-party tools, websites, drivers, utilities, repositories, payment processors, communities, or services. Those resources are controlled by third parties, may change without notice, and may have their own licenses, terms, privacy policies, or risks.

Unless expressly stated, a link or reference does not mean that VortexFPS owns, controls, sponsors, endorses, guarantees, or accepts responsibility for the third party. You are responsible for reviewing third-party terms and verifying downloads before use.

Section 12 · Ownership

Intellectual Property Rights

VortexFPS and its licensors retain all right, title, and interest in and to the Services and all associated intellectual property, including software binaries, source code, algorithms, interfaces, workflows, scripts, configuration logic, optimization methods, documentation, guides, written text, graphics, logos, branding, website design, custom profiles, downloadable materials, compilations, and other original content.

Except for the limited rights expressly granted in these Terms, no license or ownership right is transferred to you. Unauthorized copying, scraping for republication, commercial exploitation, resale, redistribution, public hosting, removal of proprietary notices, or use of VortexFPS intellectual property to create a competing commercial product or service is prohibited.

You may share a normal hyperlink to a public VortexFPS webpage. You may not rehost paid files, proprietary software, private downloads, custom customer deliverables, or substantial portions of protected content without written permission.

Section 13 · Acceptable Use

User Conduct and Trade Compliance

You agree not to misuse the Services. Prohibited conduct includes attempting to compromise the website or its infrastructure; bypassing access controls; introducing malware; scraping protected areas; impersonating another person; submitting fraudulent orders; harassing, threatening, or abusing staff or other users; using the Services for unlawful purposes; interfering with payment or delivery systems; or attempting to obtain paid content without authorization.

You may not use support, contact, upload, order, or communication systems to transmit unlawful, malicious, infringing, or intentionally harmful material.

You may not purchase, access, download, export, re-export, transfer, or use the Services in violation of applicable United States export-control laws, economic sanctions, trade restrictions, or other applicable trade laws. VortexFPS may refuse, block, suspend, or cancel a transaction where reasonably necessary to comply with sanctions, export controls, payment-processor restrictions, or other legal obligations.

Section 14 · Enforcement

Suspension, Termination, and Refusal of Service

We may refuse a new order or terminate access to unpaid or future Services where reasonably necessary for safety, security, fraud prevention, legal compliance, abusive conduct, unsupported hardware, or material violation of these Terms.

We may suspend or revoke a software license where the purchaser materially breaches the license restrictions, redistributes or resells the software without permission, compromises licensing or security mechanisms, obtains the software through fraud, or completes a fraudulent payment reversal.

Termination does not eliminate obligations that by their nature should survive, including payment obligations, intellectual-property protections, warranty disclaimers, limitations of liability, indemnification, and dispute-resolution provisions.

Section 15 · Warranty Disclaimer

Services Provided “As Is”

To the maximum extent permitted by applicable law, the website, free content, software, downloads, scripts, guides, configurations, and optimization services are provided “as is” and “as available,” with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise.

VortexFPS disclaims, to the maximum extent permitted by law, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, compatibility, quiet enjoyment, and any warranty arising from course of dealing or usage of trade.

We do not warrant that any software will be uninterrupted, error-free, compatible with every system, free from all false positives, immune from third-party changes, or continuously supported. We do not warrant that any recommendation will produce a specific performance result or remain appropriate after a future BIOS, Windows, driver, game, anti-cheat, or hardware update.

Some jurisdictions do not permit certain warranty exclusions, including exclusions affecting consumer goods or services under applicable Maryland law. No disclaimer in these Terms excludes a warranty or remedy that cannot lawfully be excluded. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law.

Section 16 · Liability

Limitation of Liability

To the maximum extent permitted by applicable law, VortexFPS and its owners, operators, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, lost revenue, lost data, loss of use, loss of goodwill, business interruption, replacement costs, or similar losses, arising out of or relating to the Services, even if advised of the possibility of such damages.

Without limiting the foregoing, you assume the risks associated with and VortexFPS disclaims liability, to the maximum extent permitted by law, for:

  • data loss, file corruption, encryption loss, lost settings, failed backups, or operating-system failure;
  • boot failure, BIOS recovery, hardware instability, component failure, overheating, voltage-related damage, reduced component lifespan, or hardware degradation;
  • driver conflicts, application incompatibility, network interruption, software crashes, lost game progress, or system downtime;
  • third-party anti-cheat flags, account suspensions, bans, platform restrictions, publisher actions, tournament restrictions, or changes to third-party software; and
  • performance results that differ from examples, benchmarks, estimates, or prior results.

The limitations in this section do not apply to liability that cannot lawfully be excluded or limited, and they do not limit remedies that applicable consumer law makes non-waivable.

Section 17 · Responsibility for Misuse

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless VortexFPS and its owners, operators, contractors, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Services, your unauthorized redistribution or commercial exploitation of VortexFPS materials, your violation of third-party rights, or your material breach of these Terms.

This section does not require you to indemnify VortexFPS for liability to the extent caused by conduct for which indemnification cannot lawfully be required.

Section 18 · Dispute Resolution

Informal Resolution, Arbitration, and Class-Action Waiver

18.1 Mandatory 30-Day Informal Resolution

Before filing arbitration or a lawsuit, the party asserting a dispute must first send a written notice describing the dispute, the relevant transaction or product, the requested relief, and sufficient contact information to allow a response (“Notice of Dispute”). Notice to VortexFPS must be sent to vortexoc@vortexfps.com with the subject line “Legal Notice: Dispute”. The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of a complete notice before commencing formal proceedings.

18.2 Individual Binding Arbitration

Except for an eligible individual claim filed in small-claims court and except where applicable law prohibits mandatory arbitration, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, a purchase, software license, or the parties’ relationship will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, as modified by these Terms.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. The arbitrator has authority to resolve disputes concerning the interpretation, applicability, enforceability, or formation of this arbitration provision, except that a court of competent jurisdiction will decide any dispute concerning the enforceability of the class-action waiver below if applicable law requires court determination.

Arbitration may be conducted by telephone, video conference, written submissions, or in person as permitted by the AAA rules. Fees will be allocated under the applicable AAA Consumer Arbitration Rules and fee schedule, subject to applicable law.

18.3 Small-Claims Court

Either party may bring an individual claim in a court of competent jurisdiction that qualifies as small claims, provided the claim remains individual and within that court’s jurisdiction.

18.4 Class-Action and Representative-Action Waiver

To the fullest extent permitted by law, disputes must be brought only in an individual capacity and not as a plaintiff, claimant, or class member in any purported class, collective, consolidated, coordinated, mass, or representative proceeding. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.

18.5 Jury-Trial Waiver

For any dispute resolved in court rather than arbitration, each party knowingly and voluntarily waives, to the fullest extent permitted by law, any right to a trial by jury.

18.6 Thirty-Day Arbitration Opt-Out

You may opt out of Sections 18.2, 18.4, and 18.5 by sending an email to vortexoc@vortexfps.com with the subject “Arbitration Opt-Out” within 30 days after the date you first accept these Terms. Your notice must include your full name, the email address used for any purchase, and a clear statement that you opt out of the arbitration agreement. Opting out of arbitration does not opt you out of the remainder of these Terms.

18.7 Severability of Dispute Terms

If a portion of this arbitration section is found unenforceable, it will be severed or narrowed to the minimum extent necessary while preserving the remainder where legally permitted. If the class-action waiver is held unenforceable as to a particular claim and that determination cannot be severed from arbitration, that claim will proceed in court rather than class arbitration.

Section 19 · Maryland Law

Governing Law, Venue, and International Users

Except for the Federal Arbitration Act and other applicable federal law, these Terms and any dispute arising from them are governed by the laws of the State of Maryland, United States, without regard to conflict-of-laws principles.

For any dispute that is not subject to arbitration and is not filed in small-claims court, the parties consent to personal jurisdiction and venue in a state or federal court of competent jurisdiction located in Maryland, unless applicable law gives you a non-waivable right to bring the dispute in another forum.

19.1 International Customers

VortexFPS may make the Services available to customers outside the United States. Access from another country does not change the Maryland governing-law provision above, but that choice of law does not deprive a consumer of mandatory protections that apply under the law of the consumer’s country or region and cannot lawfully be waived by contract.

Nothing in these Terms excludes or limits any statutory warranty, conformity right, cancellation or withdrawal right, refund right, data-protection right, forum right, or other consumer protection that applicable law makes mandatory and non-waivable. If a provision of these Terms conflicts with such a mandatory right, the mandatory right controls only to the extent of that conflict.

The Services are operated from the United States and may not be lawful, available, or suitable in every jurisdiction. You are responsible for complying with local laws applicable to your use of the Services, except that this responsibility does not transfer to you any legal obligation that applicable law places on VortexFPS.

19.2 International Data and Privacy

International users should review our Privacy Policy for information about how personal information is collected, used, disclosed, retained, and processed in connection with the Services. Personal information may be processed in the United States and by third-party service providers, subject to the Privacy Policy and applicable data-protection law.

Nothing in these Terms waives any consumer protection, statutory remedy, privacy right, or jurisdictional right that cannot lawfully be waived by contract.

Section 20 · Updates

Modifications to These Terms

We may update these Terms from time to time to reflect changes to the Services, pricing structure, technology, law, security practices, or business operations. The current version will be posted on this page with an updated effective date.

Where required by law, or when we make a material change that significantly affects existing paid rights or dispute-resolution terms, we will provide reasonable additional notice or obtain additional consent as appropriate. Changes will apply prospectively unless applicable law permits otherwise.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law. If you do not agree to a revision, you must stop using the affected Services. A material change to the arbitration agreement will not retroactively alter an already-filed dispute unless both parties agree.

Section 21 · Miscellaneous

General Contract Terms

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force, except as specifically stated in Section 18 for dispute-resolution provisions.

No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment. You may not assign or transfer your paid license or contractual rights without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, or transfer of the business, subject to applicable law.

Force majeure. VortexFPS is not responsible for delay or failure caused by events beyond reasonable control, including internet outages, payment-processor failures, cloud-service outages, platform changes, natural disasters, labor disruptions, government actions, cyberattacks, or failures of third-party infrastructure.

Entire agreement. These Terms, the Privacy Policy, the applicable product or service description, and any written order-specific terms form the entire agreement concerning the applicable Services and supersede prior or contemporaneous representations about the same subject matter.

Electronic communications. You consent to receive transaction-related communications, notices, receipts, delivery messages, and legal notices electronically at the contact information you provide, subject to applicable law.

Language. These Terms are written in English. Any translation we may provide is for convenience unless applicable law requires otherwise. If a translation conflicts with the English version, the English version controls to the extent permitted by law.

Territorial availability. We may limit or discontinue availability of a product or service in a country, region, or territory where reasonably necessary for legal compliance, payment processing, fraud prevention, sanctions compliance, technical limitations, or support constraints.
